Terms of Use
About this website
JFula.com is operated by Joseph Fula, an independent product designer, creative technologist, and AI consultant in Lowell, Massachusetts. These Terms address public use of the website and its content. The site provides general information about my background, portfolio, design work, software development, AI consulting, and related services. Its content is not a binding proposal or a guarantee of service availability.
Inquiries and client services
Browsing the site, reviewing these Terms, or sending an inquiry does not create a client relationship, a contract for services, or an obligation for either party to proceed. Services begin only after mutual agreement. Specific services, deliverables, pricing and payment, responsibilities, timelines, intellectual property rights, support, and other project terms are established separately.
Separate signed client agreements govern the services covered by those agreements. These public website Terms do not replace or modify them. Inquiry information is handled as described in the Privacy Policy. Please do not send confidential client information, passwords, financial account details, or other sensitive material through the inquiry process.
Portfolio and technology examples
Portfolio entries describe work in the context stated. Public software demonstrations, proposed workflows, AI agents, automation examples, applications, and prototypes illustrate possible approaches. They do not promise that a particular implementation will produce specific business or financial outcomes, eliminate human work, operate without errors, or meet every visitor's requirements.
AI output can contain mistakes and requires appropriate human review. Any client implementation depends on separately agreed requirements, supported integrations, testing, responsibilities, and project terms. Examples on this site are not production-performance or infrastructure guarantees.
Intellectual property and permitted use
Original design and layout, written content, images and artwork, branding, portfolio materials, software demonstrations, original code, and other materials are protected where applicable by intellectual property law. Rights belong to Joseph Fula or the respective client, employer, contributor, licensor, or other rights holder. Third-party rights, credits, and applicable licenses remain in effect.
You may view the website and make ordinary browsing copies for lawful personal use or business evaluation. Viewing does not transfer ownership or grant permission to reproduce, modify, distribute, commercially reuse, or otherwise exploit protected material, except where explicitly authorized, covered by an applicable license, or permitted by law. Published open-source licenses continue to govern the materials they cover.
Responsible use
Do not use the website for unlawful or malicious activity, unauthorized access, attempts to compromise or disrupt systems, harmful code, impersonation, fraudulent inquiries, spam, or misuse of site functions. These restrictions do not limit fair use, accessibility rights, or other lawful rights that cannot be waived.
Third-party websites and services
Links to third-party websites, software, platforms, and services are provided for convenience or reference. Their functionality, availability, terms, and privacy practices are their own. I do not control third-party services, and a link does not by itself establish endorsement, a partnership, or a guarantee about that service.
Availability and warranties
To the fullest extent permitted by applicable law, this public website and its general informational content are provided on an "as is" and "as available" basis, without express or implied warranties, including warranties of merchantability, fitness for a particular purpose, or noninfringement. I do not guarantee uninterrupted availability, accuracy, completeness, or freedom from errors.
These disclaimers do not exclude any warranty, protection, or remedy that cannot lawfully be excluded. They concern the public website and do not replace promises or warranties in a separate signed client agreement.
Limits on liability
To the fullest extent permitted by applicable law, Joseph Fula's liability arising from use of, inability to use, or reliance on general information on this public website is limited as follows: Joseph Fula is not liable for indirect, incidental, special, consequential, exemplary, or punitive losses, including resulting loss of profits, business opportunities, or data, where such exclusion is lawful and enforceable.
Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, gross negligence, or any other conduct or liability that applicable law does not permit to be excluded or limited. Mandatory consumer rights and other nonwaivable legal protections remain intact. These website limitations do not substitute for the liability provisions of a separate signed client agreement.
Changes to the website and these Terms
I may correct, update, remove, or discontinue public website content or features. Material changes to these Terms will be posted with a revised effective date, with any additional notice or agreement required by applicable law. A website update does not by itself amend an existing signed client agreement or remove rights that have already accrued.
Massachusetts law and severability
Massachusetts law governs these Terms to the extent they form an enforceable agreement and applicable law permits. Mandatory consumer protections and other nonwaivable laws that apply to you continue to apply. Whether a provision is enforceable depends on applicable law and the circumstances; merely making these Terms available does not establish that you have assented to every provision.
If a provision is held invalid or unenforceable, the remaining provisions continue only to the extent permitted by law. Any lawful narrowing of a provision must preserve applicable rights and the substance of any enforceable agreement.
